General Terms and Conditions of Sale – E-learning Training
Article 1 - Preamble
Each training course will be formalised by the signing of a training agreement.
The course in question falls into one of the categories set out in Article L.900-2, repealed by Law No. 2006-1770 of 30 December 2006: acquisition, maintenance and improvement of knowledge. Each training course is defined by a programme that complies with official standards.
Acceptance of a training agreement implies validation of the prerequisites indicated in the training programmes.
Article 2 - Financial terms and conditions
Unless otherwise specified, payment shall be made within 45 days of the date on which the requested service is provided. Any payment exceeding the contractual due date shall be subject to a late payment penalty equal to 10.75%, plus a fixed compensation of £40 (Art. L441-6 of Law 2014-626 of 18 June 2014, Article 68).
Upon signing the agreement, Groupe ACN will issue an invoice based on the agreement. All e-learning training will be payable upon signing the agreement, regardless of the trainee's attendance and progress. In return for full payment, Groupe ACN undertakes to provide the client with all documents and evidence proving the reality and validity of the expenses.
A reservation made via our Stripe online payment solution cannot give rise to a refund.
Article 3 - Trainee registrations - Invitations to attend
Unless otherwise stipulated, payment must be made within 45 days of the date on which the requested service is performed. Any payment exceeding the contractual due date will be subject to a late payment penalty equal to 10.75%, plus a fixed penalty of €40 (Art. L441-6 of Law 2014-626 of 18 June 2014, article 68).
When the agreement is signed, ACN Group will issue the invoice on the basis of the agreement. All e-learning courses will be due from the date the agreement is signed, regardless of the Trainee's attendance and progress. In return for payment in full, ACN Group undertakes to provide the client with all documents and vouchers justifying the reality and validity of the expenditure.
Bookings made via our Stripe online payment solution cannot give rise to a refund.
Registration for a training course (in-house, inter-company, virtual class or e-learning) only takes effect on receipt of a written order signed by the beneficiary company for its trainees. Registration is based on the commercial proposals or training agreements offered by ACN Group.
Artículo 4 - Discapacidad y accesibilidad
ACN Group applies an inclusive approach to disability. In order to facilitate access to our training courses for all people with disabilities, the ACN Group teams make every effort to find the most appropriate solution for each disability. For any enrolment of a person with a disability requiring prior organisation (accessibility, technical resources, human resources, adaptations, adaptation of course materials, etc.), a study will be carried out by our disability advisors.
Article 5 - Teaching resources
The teaching and technical resources used are detailed in the training data sheet: computer equipment, course booklet, video projection, practical exercises, teaching materials and tools. ACN Group guarantees that the teaching materials provided to trainees do not contain any reproduction or borrowing from another work that could restrict their use or incur the liability of the sponsor with respect to third parties.
The materials provided to employees remain the intellectual property of ACN Group.
Article 6 - Confidentiality clause
ACN Group staff personally undertake not to divulge any information relating to the client's activities of which they may become aware in the course of their work and which could be prejudicial to the client.
Article 7 - OPCO payment subrogation
OPCO payment subrogations are not accepted by ACN Group for e-learning or blended learning courses.
ACN Group is QUALIOPI certified and ensures the transfer of all training documents so that the customer can request reimbursement from their OPCO.
Article 8 - Non-performance or postponement of the agreement at ACN Group's initiative
The dates set at the customer's request are guaranteed by ACN Group. ACN reserves the right to postpone, cancel or interrupt the training service in the event of technical problems or force majeure, without compensation.
If necessary, it undertakes to propose new dates to the beneficiary to enable the training service to be provided.
Article 9 - Any disputes
If a dispute or difference is not resolved amicably, the Meaux court will have sole jurisdiction. sole jurisdiction to settle a dispute.
